Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs the use of the NexNodo platform, website, APIs, Marketplace, cloud infrastructure services, AI infrastructure services, orchestration systems, and related products and services (collectively, the "Services") provided by NexNodo Inc., a Delaware corporation ("NexNodo", "we", "our", or "us").
This AUP forms part of the NexNodo Terms of Service and applies to all Customers, users, Vendors, Infrastructure Providers, partners, contractors, and any other individuals or entities accessing or using the Services.
NexNodo reserves the right to modify this AUP at any time by publishing an updated version on the NexNodo website or platform.
1. General Prohibited Conduct
Customers may not use the Services for unlawful, abusive, harmful, deceptive, fraudulent, unauthorized, or irresponsible activities.
Customers remain responsible for all activities conducted through their Accounts, infrastructure environments, workloads, AI systems, Marketplace deployments, APIs, clusters, applications, and associated infrastructure resources, whether performed directly by the Customer or by third parties using the Customer's Account or infrastructure.
Customers additionally may not use the Services to assist, facilitate, enable, encourage, or support activities that would violate this AUP if performed directly by the Customer.
2. Illegal Activities
Customers may not use the Services to engage in, support, facilitate, distribute, promote, or encourage illegal conduct or unlawful activity under applicable local, national, or international laws or regulations.
Prohibited activities include, without limitation:
- fraud,
- phishing,
- identity theft,
- unauthorized financial activity,
- illegal gambling,
- unlawful surveillance,
- money laundering,
- sanctions violations,
- trafficking of illegal goods or services,
- operation of illegal marketplaces,
- or distribution of unlawful materials.
Customers may not use the Services in connection with activities prohibited under United States export laws, sanctions regulations, anti-money laundering laws, or applicable international trade restrictions.
3. Fraudulent, Deceptive, or Harmful Conduct
Customers may not use the Services to engage in deceptive, misleading, fraudulent, malicious, or harmful conduct.
Prohibited activities include:
- impersonation of individuals or organizations,
- deceptive identity practices,
- phishing operations,
- fraudulent advertisements,
- scam operations,
- financial fraud,
- credential theft,
- social engineering attacks,
- deceptive automation systems,
- malware distribution,
- or operation of fraudulent schemes.
Customers may not engage in conduct that could reasonably damage NexNodo's operations, infrastructure, Marketplace ecosystem, Vendors, Infrastructure Providers, reputation, or relationships with third parties.
4. Intellectual Property Violations
Customers may not use the Services in a manner that violates, infringes, misappropriates, or unlawfully exploits intellectual property rights or proprietary rights belonging to any individual or entity.
This includes violations relating to:
- copyrights,
- trademarks,
- patents,
- trade secrets,
- software licenses,
- database rights,
- privacy rights,
- publicity rights,
- or other proprietary rights.
Customers additionally may not use the Services to distribute or facilitate unauthorized copies of software, media, datasets, AI models, or copyrighted materials.
Marketplace applications and open-source software remain subject to their applicable license terms and obligations.
5. Harmful, Abusive, or Violent Content
Customers may not use the Services to distribute, host, generate, deploy, promote, or facilitate:
- child sexual abuse material,
- unlawful pornography,
- non-consensual intimate imagery,
- exploitative content,
- violent extremism,
- terrorism-related content,
- threats of violence,
- targeted harassment,
- hate speech,
- abusive conduct,
- or content promoting physical harm or unlawful activity.
Customers may not use AI systems, generative models, MCP servers, automation workflows, or Marketplace applications to generate or distribute prohibited content.
6. Security Violations
Customers may not use the Services to violate, compromise, interfere with, or attempt to circumvent the security, confidentiality, integrity, or availability of any network, infrastructure environment, system, application, device, or service.
Prohibited activities include:
- unauthorized access attempts,
- vulnerability exploitation,
- credential attacks,
- port scanning,
- penetration attempts,
- interception of data,
- unauthorized monitoring,
- malicious automation,
- privilege escalation,
- exploitation of APIs,
- deployment of malware,
- ransomware activity,
- spyware,
- botnet activity,
- Trojan horses,
- worms,
- or other malicious technologies.
Customers may not test, probe, scan, penetrate, or assess vulnerabilities of NexNodo systems, Infrastructure Providers, Marketplace systems, Vendors, or related infrastructure environments without NexNodo's prior written authorization.
7. Network Abuse and Infrastructure Misuse
Customers may not interfere with the normal operation, stability, performance, or availability of the Services or third-party infrastructure environments.
Prohibited conduct includes:
- denial-of-service attacks,
- distributed denial-of-service attacks,
- traffic flooding,
- broadcast attacks,
- protocol abuse,
- excessive resource consumption,
- abusive automation,
- network disruption,
- unauthorized scraping,
- unauthorized crawling,
- open proxy operation,
- open recursive DNS services,
- unauthorized Tor exit nodes,
- spam relays,
- or infrastructure abuse.
Customers may not intentionally consume disproportionate infrastructure resources in a manner that negatively impacts other users, Infrastructure Providers, Vendors, or platform stability.
NexNodo reserves the right to implement usage limitations, resource restrictions, throttling mechanisms, workload isolation, or operational controls necessary to maintain platform reliability and infrastructure integrity.
8. Cryptocurrency Mining
Customers may not engage in cryptocurrency mining, blockchain mining, proof-of-work operations, or related resource-intensive blockchain activity without NexNodo's prior written authorization.
Unauthorized mining activity may result in immediate suspension or termination of Services.
9. E-Mail Abuse and Spam
Customers may not use the Services to distribute unsolicited bulk communications, spam, phishing emails, deceptive communications, or unauthorized promotional messaging.
Customers may not obscure message origins, falsify email headers, disguise sender identities, operate spam infrastructure, or use the Services in connection with abusive email activity.
Customers engaging in legitimate email-related operations must comply with all applicable anti-spam and privacy laws and maintain appropriate consent mechanisms and abuse management procedures.
10. AI Systems and Automated Services
NexNodo may provide AI-related infrastructure, orchestration systems, AI agents, MCP integrations, inference systems, automation tooling, and generative AI functionality.
Customers may not use AI-related Services to violate applicable laws, infringe intellectual property rights, impersonate individuals, generate fraudulent or deceptive content, create malicious automation systems, generate harmful code, distribute malware, bypass security safeguards, produce exploitative content, facilitate cyberattacks, conduct disinformation campaigns, generate unlawful synthetic content, create non-consensual deepfakes, or facilitate unlawful surveillance or abuse.
Customers may not attempt to bypass, disable, interfere with, or undermine AI safety systems, operational restrictions, moderation systems, or platform safeguards implemented by NexNodo or third-party AI providers.
Customers remain solely responsible for prompts, generated outputs, automation workflows, MCP interactions, datasets, AI agents, AI-generated content, and AI-related operational activity deployed through the Services.
11. Marketplace and Vendor Services
Customers may not use the Marketplace to distribute malicious software, distribute infringing applications, publish deceptive integrations, bypass Vendor licensing systems, abuse Marketplace infrastructure, manipulate Marketplace rankings, exploit Marketplace APIs, or interfere with Marketplace operations.
Vendors remain responsible for ensuring that applications, connectors, MCP servers, integrations, and Marketplace offerings comply with applicable laws, licensing obligations, intellectual property requirements, and security expectations.
NexNodo reserves the right to suspend, restrict, remove, review, audit, or disable Marketplace offerings at any time for operational, legal, security, licensing, or business reasons.
12. Excessive Resource Usage
Customers may not use the Services in a manner that disproportionately consumes shared infrastructure resources or negatively impacts infrastructure stability, orchestration systems, Marketplace functionality, AI systems, or the experience of other users.
NexNodo may implement operational controls, workload restrictions, resource limitations, throttling measures, or suspension mechanisms necessary to preserve infrastructure availability, security, performance, or reliability.
13. Monitoring and Enforcement
NexNodo reserves the right, but does not assume the obligation, to monitor, investigate, review, audit, preserve, disclose, or remove content, workloads, deployments, Marketplace activity, infrastructure activity, AI-related activity, or operational telemetry where reasonably necessary to enforce this AUP, protect the Services, investigate suspected violations, comply with legal obligations, maintain platform security, prevent abuse or fraud, preserve operational integrity, or protect Customers, Infrastructure Providers, Vendors, and third parties.
NexNodo may cooperate with law enforcement authorities, regulators, Infrastructure Providers, Vendors, or other appropriate third parties in connection with investigations relating to unlawful conduct, abuse, fraud, cybersecurity incidents, export violations, or violations of this AUP.
14. Consequences of Violations
Violations of this AUP may result in actions including:
- content removal,
- workload suspension,
- Marketplace restrictions,
- API restrictions,
- infrastructure throttling,
- deployment disabling,
- AI workload suspension,
- account suspension,
- termination of Services,
- permanent account termination,
- legal action,
- or reporting to law enforcement or regulatory authorities.
NexNodo reserves sole discretion in determining whether conduct violates this AUP and the appropriate enforcement response.
15. Reporting Violations
If you become aware of conduct that may violate this AUP, please contact NexNodo with relevant information regarding the suspected violation.

16. Changes to this Policy
NexNodo may revise, update, amend, or modify this AUP from time to time to reflect changes in legal requirements, infrastructure architecture, Marketplace operations, AI-related functionality, operational practices, security practices, or business operations.
Updated versions will be posted on the NexNodo website with revised effective dates.
Continued use of the Services following publication of revised policies constitutes acceptance of the updated AUP.
