AI Acceptable Use Policy

This AI Acceptable Use Policy ("AI AUP") governs the use of AI-related services, AI infrastructure, AI orchestration systems, MCP integrations, automation systems, inference environments, AI agents, Marketplace AI applications, and related AI functionality (collectively, "AI Services") provided through the NexNodo platform and Services by NexNodo Inc. ("NexNodo", "we", "our", or "us").

This AI AUP supplements the NexNodo Terms of Service, Acceptable Use Policy, Privacy Policy, Marketplace Terms, and other applicable agreements governing use of the Services.

Customers, users, Vendors, partners, Infrastructure Providers, and third parties accessing or using AI Services must comply with this AI AUP.

NexNodo reserves the right to investigate, restrict, suspend, terminate, or report activity that violates this AI AUP or that may expose NexNodo, Customers, Vendors, Infrastructure Providers, or third parties to operational, legal, reputational, or security risk.

1. Scope of AI Services

NexNodo may provide or facilitate access to:

  • AI infrastructure,
  • GPU inference environments,
  • LLM runtimes,
  • AI orchestration systems,
  • AI agents,
  • automation workflows,
  • MCP servers,
  • AI integrations,
  • vector databases,
  • AI development tooling,
  • AI-related Marketplace applications,
  • inference APIs,
  • generative AI systems,
  • and related AI infrastructure functionality.

AI Services may include third-party AI systems, open-source AI models, proprietary Vendor applications, Customer-deployed models, or integrations operated by independent third parties.

Customers remain solely responsible for their use of AI Services and all outputs, workloads, prompts, automation systems, datasets, and AI-generated content associated with their Accounts.

2. General Principles

Customers may not use AI Services in a manner that is unlawful, harmful, deceptive, abusive, unsafe, discriminatory, exploitative, fraudulent, malicious, or otherwise inconsistent with applicable laws or responsible AI practices.

Customers are responsible for evaluating AI outputs, validating generated content, implementing appropriate safeguards, maintaining human oversight where appropriate, and ensuring compliance with applicable legal, ethical, operational, and regulatory requirements.

AI-generated outputs may contain inaccuracies, hallucinations, biases, incomplete information, or unintended results. NexNodo does not guarantee the accuracy, reliability, legality, or suitability of AI-generated outputs.

3. Illegal or Harmful Activities

Customers may not use AI Services to:

  • violate applicable laws,
  • facilitate criminal activity,
  • conduct fraud,
  • engage in phishing,
  • facilitate identity theft,
  • generate malicious software,
  • conduct cyberattacks,
  • facilitate unauthorized intrusion,
  • distribute ransomware,
  • evade sanctions,
  • conduct unlawful surveillance,
  • or engage in unlawful automation activity.

Customers may not use AI Services to facilitate or promote violence, terrorism, violent extremism, hate speech, targeted harassment, child exploitation, trafficking, unlawful pornography, non-consensual intimate imagery, or unlawful exploitation of individuals.

4. Harmful or Deceptive AI Content

Customers may not use AI Services to generate, distribute, deploy, or facilitate deceptive synthetic media, fraudulent impersonation, misleading deepfakes, election manipulation, disinformation campaigns, deceptive automation systems, social engineering content, fake identities, fraudulent reviews, fake endorsements, or deceptive communications intended to mislead individuals or organizations.

Customers may not falsely represent AI-generated content as authentic human-generated content where such representation would be deceptive or unlawful.

5. Cybersecurity and Malware

Customers may not use AI Services to:

  • generate malware,
  • generate ransomware,
  • automate credential attacks,
  • facilitate exploitation of vulnerabilities,
  • develop malicious payloads,
  • conduct phishing campaigns,
  • create spyware,
  • automate cyberattacks,
  • bypass security systems,
  • facilitate botnet activity,
  • or assist unauthorized access to systems or networks.

Customers may not use AI agents, MCP servers, automation workflows, or AI orchestration systems to conduct malicious or unauthorized cybersecurity activity.

Authorized security research must comply with the NexNodo Vulnerability Disclosure Policy and applicable laws.

6. Privacy and Personal Data

Customers may not use AI Services in violation of applicable privacy, data protection, biometric, or surveillance laws.

Customers remain solely responsible for ensuring they possess all necessary rights, permissions, authorizations, and legal bases required to process personal information, confidential information, sensitive data, regulated data, biometric data, healthcare data, financial data, or other protected information through AI Services.

Customers may not use AI Services for unlawful facial recognition, biometric profiling, behavioral surveillance, social scoring, or invasive monitoring activities.

Customers remain responsible for implementing appropriate safeguards for prompts, datasets, generated outputs, vector databases, AI agents, MCP integrations, and AI-related workflows.

7. Intellectual Property and Proprietary Rights

Customers may not use AI Services to infringe copyrights, violate trademarks, misappropriate trade secrets, unlawfully reproduce proprietary content, generate infringing materials, bypass licensing restrictions, or unlawfully exploit intellectual property rights belonging to others.

Customers remain responsible for ensuring lawful use of prompts, datasets, models, generated outputs, embeddings, vector databases, AI-generated assets, and AI-related workflows.

Marketplace AI applications, open-source models, and Vendor AI systems may additionally be subject to separate licensing terms and restrictions.

8. AI Agents, MCP Servers, and Automation Systems

Customers may deploy AI agents, MCP servers, automation workflows, orchestration systems, and related AI infrastructure through the Services.

Customers remain solely responsible for agent behavior, automation workflows, external integrations, API interactions, connected systems, generated actions, data access permissions, and operational safeguards associated with such systems.

Customers may not deploy AI agents, MCP servers, or automation systems designed to bypass security controls, perform unauthorized actions, harvest credentials, scrape protected systems, exfiltrate data, evade detection systems, conduct surveillance, or otherwise violate applicable laws or agreements.

Customers are responsible for implementing appropriate safeguards, human oversight, rate limits, permission boundaries, monitoring systems, and operational controls associated with autonomous or semi-autonomous AI systems.

9. Marketplace AI Applications

Marketplace applications, AI connectors, MCP servers, AI integrations, and Vendor-provided AI services may be provided by independent Vendors or third parties.

NexNodo does not guarantee Vendor AI outputs, model behavior, safety controls, operational reliability, legal compliance, or security practices associated with third-party AI systems.

Customers use Marketplace AI applications at their own risk. Vendors remain solely responsible for their AI applications, models, integrations, outputs, and operational practices.

10. Infrastructure Abuse and Resource Usage

Customers may not use AI Services in a manner that disrupts infrastructure stability, excessively consumes shared GPU resources, negatively impacts platform performance, bypasses usage limitations, circumvents billing systems, abuses orchestration systems, or threatens the operational integrity of the Services.

NexNodo reserves the right to implement usage limitations, rate limits, workload restrictions, GPU quotas, orchestration controls, monitoring systems, throttling mechanisms, or operational safeguards necessary to preserve platform stability, security, and reliability.

Unauthorized cryptocurrency mining, proof-of-work operations, or unauthorized resource-intensive workloads are prohibited unless explicitly authorized by NexNodo.

11. Monitoring and Enforcement

NexNodo reserves the right, but does not assume the obligation, to monitor, investigate, review, audit, preserve, disclose, suspend, restrict, or remove AI-related workloads, deployments, prompts, outputs, automation systems, MCP activity, Marketplace deployments, operational telemetry, infrastructure usage, or related activity where reasonably necessary to enforce this AI AUP, maintain platform security, protect infrastructure integrity, prevent abuse or fraud, comply with legal obligations, preserve operational stability, investigate suspected violations, or protect Customers, Vendors, Infrastructure Providers, or third parties.

12. Suspension and Termination

Violations of this AI AUP may result in actions including:

  • workload suspension,
  • AI workload restrictions,
  • Marketplace restrictions,
  • MCP server disabling,
  • API limitations,
  • infrastructure throttling,
  • GPU quota restrictions,
  • deployment disabling,
  • account suspension,
  • termination of Services,
  • permanent account termination,
  • legal action,
  • or referral to law enforcement or regulatory authorities.

NexNodo reserves sole discretion in determining whether conduct violates this AI AUP and the appropriate enforcement response.

13. No Warranty

AI Services are provided on an "AS IS" and "AS AVAILABLE" basis. NexNodo does not warrant that AI Services will be accurate, uninterrupted, error-free, unbiased, secure, compliant with any specific regulatory framework, or suitable for any particular purpose.

Customers remain solely responsible for evaluating and validating AI-generated outputs and operational decisions associated with AI systems deployed through the Services.

14. Changes to this Policy

NexNodo may revise, update, amend, or modify this AI AUP from time to time to reflect changes in applicable laws, AI regulations, operational practices, infrastructure architecture, Marketplace functionality, security practices, AI capabilities, or business operations.

Updated versions will be posted on the NexNodo website with revised effective dates.

Continued use of AI Services following publication of revised policies constitutes acceptance of the updated AI AUP.
