Third-Party Application Terms

These Third-Party Application Terms (“Third-Party Terms”) govern customer access to, deployment of, use of, and interaction with third-party applications, open-source software, connectors, MCP servers, integrations, and related non-NexNodo software content made available through the NexNodo platform or NexNodo Marketplace.
These Third-Party Terms form part of and are incorporated into the applicable NexNodo Terms of Service, Marketplace Terms, Cloud Service Agreement, Order Form, Enterprise Agreement, or equivalent customer agreement governing customer use of the NexNodo platform.
Capitalized terms not otherwise defined herein shall have the meanings assigned under the applicable customer agreement.
1. PURPOSE AND SCOPE
The NexNodo platform and NexNodo Marketplace may make available applications, software packages, deployment templates, MCP servers, integrations, connectors, observability tooling, databases, developer tooling, AI infrastructure tooling, and related software content originating from third parties, open-source communities, software vendors, maintainers, contributors, licensors, or equivalent external parties.
These Third-Party Terms establish the framework governing customer interaction with such third-party content.
Examples may include technologies such as:
- PostgreSQL
- Kafka
- MongoDB
- Grafana
- Prometheus
- DBeaver
- OpenWebUI
- MCP servers
- connectors
- or substantially equivalent third-party or open-source software offerings.
2. DEPLOYMENT ENABLEMENT MODEL
Unless expressly stated otherwise, NexNodo provides deployment enablement, infrastructure orchestration functionality, deployment workflows, marketplace catalog functionality, or equivalent platform tooling relating to third-party applications.
NexNodo does not, solely by making software available through the NexNodo Marketplace, become the software owner, software licensor, software maintainer, software publisher, software reseller, software distributor, or managed service operator for such software.
Unless expressly identified otherwise within a marketplace listing, deployment description, written agreement, or service description:
- third-party applications do not incur separate NexNodo software license fees
customers pay only for underlying infrastructure resources, cloud resources, Kubernetes resources, GPU resources, storage resources, networking resources, or equivalent infrastructure consumption associated with deployment and operation of applicable software.
Infrastructure consumption remains governed by applicable NexNodo Billing Policy, Refund Policy, pricing framework, and customer agreement.
3. NO MANAGED SERVICE OBLIGATION
Unless expressly stated otherwise by NexNodo, third-party applications made available through the NexNodo platform are not operated as NexNodo managed services.
Without limitation, NexNodo does not automatically undertake obligations relating to:
- managed Kafka operations
- managed PostgreSQL operations
- managed MongoDB operations
- managed database administration
- software lifecycle management
- operational maintenance
- patch management
- application monitoring
- backup administration
- high availability management
- or equivalent managed application operations.
Customers remain responsible for operation, administration, lifecycle management, configuration, maintenance, and governance of deployed third-party applications unless otherwise expressly agreed in writing.
4. THIRD-PARTY OWNERSHIP AND LICENSING
Third-party applications, open-source software, MCP servers, connectors, integrations, software packages, and related software content remain subject to applicable ownership, licensing, branding, intellectual property, and software governance frameworks established by the relevant software owners, maintainers, licensors, contributors, vendors, or communities.
Such software may be governed by:
- open-source licenses
- commercial licenses
- community licensing models
- maintainer licensing frameworks
- vendor terms
- or substantially equivalent upstream software licensing frameworks.
Customers acknowledge that applicable upstream software licenses may independently govern:
- software usage
- modification rights
- redistribution rights
- support entitlements
- source code access rights
- commercial usage rights
- compliance obligations
- attribution requirements
- or equivalent software licensing matters.
Customers remain responsible for complying with applicable upstream licensing obligations.
5. SUPPORT MODEL
Third-party applications available through the NexNodo platform may be:
- community supported
- vendor supported
- maintainer supported
- commercially supported
- independently supported
- or unsupported.
Unless expressly stated otherwise, NexNodo does not provide guaranteed software support, maintenance commitments, upgrade management, patch management, troubleshooting obligations, compatibility guarantees, operational assistance, or lifecycle commitments relating to third-party applications.
Where NexNodo elects to provide commercially reasonable deployment assistance, informational guidance, documentation references, or marketplace-related operational help, such assistance shall not create continuing support obligations unless expressly agreed in writing.
6. CUSTOMER RESPONSIBILITIES
Customers remain solely responsible for evaluating, deploying, configuring, securing, operating, monitoring, maintaining, and governing third-party applications deployed through the NexNodo platform.
Customer responsibilities may include, where applicable:
- configuration management
- credential management
- secret management
- patch management
- software upgrades
- security hardening
- backup practices
- compliance validation
- software compatibility testing
- resource scaling
- operational monitoring
- workload governance
- data protection obligations
- or substantially equivalent operational responsibilities.
Customers remain responsible for determining whether third-party applications are suitable for their intended technical, regulatory, security, operational, or business requirements.
7. SECURITY AND COMPLIANCE DISCLAIMERS
NexNodo does not independently certify, warrant, audit, validate, or guarantee the security posture, software quality, compliance status, licensing treatment, operational behavior, maintainability, or suitability of third-party applications for customer-specific requirements.
Customers should independently evaluate, where applicable:
- software provenance
- maintainer reputation
- licensing implications
- security posture
- community maturity
- operational requirements
- compliance compatibility
- data protection considerations
- or equivalent technical, legal, security, and commercial factors.
Nothing herein shall be interpreted as a NexNodo certification, regulatory approval, compliance guarantee, security attestation, or software assurance statement relating to third-party applications.
8. DISCLAIMERS AND LIMITATION OF RESPONSIBILITY
To the maximum extent permitted under applicable law, third-party applications, open-source software, connectors, MCP servers, integrations, and related software content are made available on an “AS IS” and “AS AVAILABLE” basis.
Unless expressly stated otherwise, NexNodo disclaims warranties, guarantees, representations, commitments, and assurances relating to:
- software availability
- software quality
- software fitness
- software security
- software compatibility
- software support continuity
- software maintenance continuity
- deployment outcomes
- business outcomes
- community support availability
- or equivalent matters relating to third-party software.
To the maximum extent permitted by applicable law, NexNodo shall not be responsible for losses, software defects, vulnerabilities, operational failures, maintainer actions, vendor decisions, community project changes, licensing disputes, customer deployment outcomes, customer workload issues, or equivalent consequences arising from third-party applications.
9. FUTURE SOFTWARE MODELS
The NexNodo Marketplace may, from time to time, include software offerings governed by commercial licenses, proprietary software models, enterprise software terms, vendor agreements, paid software frameworks, or equivalent software distribution models.
Where applicable, additional software-specific terms, vendor terms, enterprise licensing terms, commercial software terms, or proprietary software conditions may apply.
10. RELATIONSHIP TO OTHER DOCUMENTS
These Third-Party Terms operate together with:
- Marketplace Terms
- Terms of Service
- Billing Policy
- Refund Policy
- Customer Service Level Agreement
- Open Source Software Policy
- MCP / Connector Publishing Terms
- and equivalent NexNodo policies.
To the extent of direct conflict regarding software licensing treatment, applicable upstream software licenses shall govern the software itself.
Except as expressly modified herein, the applicable customer agreement shall remain in full force and effect.
